25 Systemic Improvement – Preparation of tender terms & conditions. CTEO during investigation of a work had made observation in respect of a clause ‘With- holding and lien in respect of sums due from contractor’ wherein it was mentioned that ‘Provided that the AAI shall not be entitled to recover-any sum overpaid, nor the contractor shall be entitled to payment of any sum paid short where such payment has been. agreed upon between the Executive Director Airport Systems/General Manager Airport Systems on the one hand and the contractor on the other under any term of the contract permitting payment for work after assessment by the Executive Director Airport Systems/ General Manager Airport System ‘ gives discretionary powers to AAI officials. 26 Transaction in Movable/Immovable Property Permission to acquire immovable properties was not being processed through personal files instead it is processed in separate files by the Airports where he was posted at that point of time. If all the premissions/ sanctions are processed through the personal file of each employee, it is retained till superannuation of employee wherever the official is posted. Considering this, it is suggested to take up with HR Department to make a policy that henceforth all the issues related to acquisition of movable / immovable property sanctions/ permissions is required to be handled through the personal file of respective employee so as to ensure that these vital documents remain available till superannuation of the employee. 28 Turn Over Criteria in IT Tenders It was recommended that clearer & more specific guidelines may be issued regarding which conditions of MEITY guidelines will be adopted in lT tenders. Such specific guidelines could bring out: a)Name of specific lT works for incorporating the particular criterion from MEITY guidelines e.g. Related Turnover/ Net Sales Turnover etc'. b)Clarity on the participation of the minimum number of Bidders in the lT Tenders, while adopting of MEITY guidelines. 29 Systematic improvement related to the work experience criteria in the tender for the Services/AMC. ln case the tender is called for Services/AMC, to be provided for more than 01 year, past work experience criteria from the prospective bidders is decided on the basis of cost of Services /AMC for complete period whereas it should be considered for 01 year only to enhance competitive bidding Technical Circular No. 01/2023 dt. 18.09.2023
30 Monitoring of project works through PMC and execution of Extra/ Substitute Items by AAI. i) Projects was monitored by Project Management Consultant (PMC) ,but then the question arises as to who monitors PMC and how effective that monitoring is. ii) As per clause-12 of the contract agreement, the Engineer-in-Charge of AAI was given power to make alteration in, omissions from, additions to, or substitutions for the original specifications, drawings, designs and instructions that may appear to him to be necessary or advisable during the progress of work. This gives a broad, general and sweeping power to Engineer-in-Charge. Thus, the Engineer-in-Charge may make such alterations/ additions/ omission/ substitution in the original specifications, drawing, design and instruction that the whole character/ basic features and objectives of the project may be lost without the knowledge of Tender Approving/ Competent Authority.
